Terms of Service

1. Acceptance of these Terms

By creating a Beautly account you agree to these Terms of Service. If you do not agree, please do not use the service.

2. Who we are

Beautly is provided by Rafael Martins, trading as Beautly (“Beautly”, “we”, “us”) — an individual sole trader established in the Netherlands, not a registered company. We provide the software; your order and your payment are handled by our reseller, as described in section 9.

We reply within 1 (one) business day. Support is provided by e-mail; we do not currently operate a support phone line.

3. The service

Beautly is a SaaS management platform for hair salons, barbershops, beauty clinics and similar businesses. Depending on your plan it may include the calendar and online booking, client and service records, a public booking page, notifications, integrations, reports and the other features described on our plans page.

4. Plans

Beautly is offered as a free plan (Free) and as paid plans (Essential, Professional and Premium). The features, usage limits and current prices of each plan are the ones shown on the plans page, which prevails over any summary given here or in marketing material.

Plans or features announced as “coming soon” cannot be purchased until they actually launch.

5. 30-day free trial

New accounts get 30 (thirty) days of free use with the features of the Professional plan, counted from the day the account is created, and no credit card is required.

You may subscribe to a paid plan at any point during the trial, and the free days you have left are not lost: the paid period only starts counting after they end. The full rules are in our Refund Policy.

When the trial ends, your account is not blocked and you are not charged automatically: it moves to the Free plan under sections 6 to 8 below.

6. Free plan: what is included

The Free plan costs nothing and does not expire. It includes:

  • calendar and appointment management;
  • client and service records;
  • public booking page;
  • e-mail notifications.

The Free plan does not include, among other paid-plan features:

  • your own branding on the public booking page (see section 8);
  • reports;
  • retention automations and satisfaction surveys (NPS);
  • Google Calendar and WhatsApp integrations;
  • campaigns, commissions, packages and waiting list.

7. Free plan usage limits

The Free plan is subject to the following limits per account:

  • 1 (one) active staff member;
  • 50 (fifty) appointments per month;
  • 50 (fifty) client records.

When a limit is reached, creating new records of that type is unavailable until the start of the account's next monthly cycle (for appointments) or until space is freed or the account is upgraded (for clients and staff). While the monthly appointment limit is reached, the public booking page stops accepting new bookings.

Reaching a limit never deletes data. Appointments, clients and everything else already recorded stay available to view, edit and export under section 14. If your account is above these limits when it moves from the trial or from a paid plan to Free, existing data is preserved: only the creation of new records is blocked until the account is back within the plan's limits or upgraded. Features not included in the Free plan are switched off, and the data they already produced stays available to view and export. If more than one staff member exists, you choose which one stays active; the others are deactivated, not deleted.

8. The “Made with Beautly” credit

On Free plan accounts, the public booking page shows a “Made with Beautly” credit linking to our website. Removing that credit and using your own branding on the public page are paid-plan features. By using the Free plan you agree to this credit being shown.

9. Payment, reseller and Merchant of Record

Paid plans are billed monthly on a recurring basis, at the price shown on the plans page when you subscribe. Prices are shown in euros; the final amount, the currency and any applicable VAT or sales tax are calculated and shown at checkout, based on the country you are buying from.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

This means Paddle.com Market Ltd — not Rafael Martins, trading as Beautly — is your counterparty for the purchase, issues your invoice, collects payment and handles any refund. Your purchase is also governed by the Paddle Checkout Buyer Terms. We never see or store your card details. You can still reach us directly at any time using the channels in section 20, and we will take it up with Paddle on your behalf.

10. Cancellation and plan changes

You can cancel your subscription at any time from your settings, with no penalty and no minimum term. You keep access to the paid features until the end of the period you have already paid for, and no further charges are made.

After that period ends, your account is not blocked and nothing is deleted: it moves to the Free plan with the features and limits of sections 6 to 8. If you would rather close the account for good, request deletion under section 14.

If a payment fails, we may switch off the paid features after notifying the e-mail address on the account, in which case the account also moves to the Free plan, without prejudice to amounts already due.

11. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. In short: your first payment is fully refundable if you ask before the paid period starts or within 14 (fourteen) days of the payment — whichever is later.

Because Paddle.com Market Ltd is the Merchant of Record, the refund is issued by Paddle, not by us. Ask them or ask us, and we will pass the request on. Nothing in this policy reduces any statutory right you may have, including the right of withdrawal available to consumers in the EU and the UK.

12. Changing, limiting or discontinuing the Free plan

The Free plan does not expire with time and never converts into a paid plan on its own. That does not mean we commit to keeping it in our catalogue indefinitely.

We may change the Free plan's features and limits, introduce new limits, restrict it to new accounts or discontinue it entirely. Changes that do not reduce features or limits already available to your account — improvements, fixes, higher limits — may take effect immediately.

Changes that reduce features or limits already available to your account, and the discontinuation of the Free plan, are announced at least 30 (thirty) days in advance, by e-mail to the address on the account and by a notice in the app, stating what changes, when it takes effect and what your options are, including the paid plans and exporting your data. During that period you may upgrade, export your data or close the account with no penalty.

The 30-day notice does not apply when the change or interruption results from: (i) breach of these Terms, abusive, fraudulent or unlawful use, or a risk to the security of the platform, of other users or of third parties, under section 13; (ii) a legal, regulatory, judicial or administrative requirement; or (iii) an event beyond our reasonable control that prevents the service from being provided, such as a serious failure or discontinuation of an essential infrastructure supplier, or force majeure. In those cases we notify you as soon as we can.

As nothing is paid for the Free plan, changing or discontinuing it gives no right to a refund. This does not affect your right to access, export and port your data under section 14.

13. Suspension and termination for breach or abuse

On any plan, free or paid, we may suspend or terminate your access immediately where there is: breach of these Terms or of applicable law; fraud, including in obtaining the trial or creating multiple accounts to get around the Free plan limits; use of the platform to send unsolicited messages or unlawful or offensive content; attempted unauthorised access, reverse engineering or deliberate overloading of our systems; or a concrete risk to the security, integrity or availability of the platform.

Whenever it is reasonable and legally possible, we will tell you why, say what needs to be fixed and give you the chance to export your data. You can challenge the decision through the support channels in section 20. This is a different matter from the discontinuation of the Free plan in section 12.

If we suspend a paid account through no fault of yours, the unused portion of the period already paid for is refunded, as described in the Refund Policy.

14. Exporting, retaining and deleting data

Your account data is available to view in the app at any time, on any plan. The personal data in your own profile can be exported directly from the app.

Exporting the salon's database — clients, services and appointment history — is done on request through our contact channels, on any plan and at no cost. We deliver the file in a commonly used format within 15 (fifteen) days of the request, in line with the rights of access and data portability under Articles 15 and 20 of the GDPR.

If the Free plan is discontinued or the service is shut down, you can request an export throughout the notice period in section 12 and for at least 30 (thirty) days after losing access, unless we are legally prevented. In the cases in section 13, export may be restricted where the law or an order from a competent authority requires it.

Once the account is closed, data is deleted or anonymised within the periods and conditions described in our Privacy Policy, except where we are required to keep it to comply with a legal obligation. We recommend exporting your data before requesting deletion.

15. Your responsibilities

You are responsible for the accuracy of the data you enter, for the security of your password, for staying within the limits of your plan and for using the platform lawfully — including having a lawful basis for processing your own clients' personal data, for which you are the controller.

16. Privacy

How we handle personal data is described in our Privacy Policy, in line with the General Data Protection Regulation (EU) 2016/679 (GDPR) and, where applicable, the UK GDPR.

17. Availability and limitation of liability

We use reasonable commercial efforts to keep the platform available and stable, but we do not guarantee uninterrupted availability or a minimum uptime percentage. The service may be unavailable for scheduled maintenance, emergency fixes, failures of third parties we depend on, or events outside our control.

We are not liable for indirect losses arising from the use of, or inability to use, the service, including loss of profit and lost booking opportunities.

The Free plan is provided as is, without priority support and without any guarantee that its features will be maintained beyond section 12. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the law that applies to you, including your statutory rights as a consumer.

18. Governing law

These Terms are governed by the laws of the Netherlands, and any dispute arising from them shall be submitted to the competent courts of the Netherlands. We chose Dutch law because that is where the provider is established and operates, and where the service is run from.

Regardless of what is agreed here, if you are a consumer you keep the protection of the mandatory rules of the law of the country where you live, and you may bring proceedings before the courts of that country.

19. Changes to these Terms

We may update these Terms. Changes that restrict your rights or reduce features already available are announced by e-mail 30 (thirty) days in advance; other changes, 15 (fifteen) days in advance. Purely editorial changes, or changes required by law or by a competent authority, may take effect immediately with notice afterwards. Continuing to use the service after the notice period means you accept the new Terms; if you do not agree, you may close your account with no penalty, after exporting your data.
